TERMS OF SERVICE (TOS) – @CopiTheCat
By commissioning CopiTheCat, the client confirms that they have read,
understood, and agreed to the following terms.
1. General Information & Contact
1. Services Offered: Digital Furry Art of all types: Icons, Headshots, Halfbodies, Fullbodies, Reference Sheets (Refs), Emotes, various YCHs, and more.2. Main Contact: Direct Message (DM) via Twitter (@CopiTheCat) or Instagram (@copithecatw).3. Working Hours: Monday to Friday (Spain/Barcelona time zone). I do not work on Saturdays, Sundays, or public holidays. I reply to messages when available during my working days.
2. Commission Process & Payment
2.1 Request and Acceptance1. The client must send a DM with a clear character reference image followed by the type of commission requested.2. The client must provide all important information needed for the commission, including character reference, pose, expression, outfit, accessories, markings, background, mood, and any specific details they want included.3. If I reply to your message and confirm availability, the commission is considered accepted.4. Upon acceptance, specific details will be discussed and the final price will be confirmed before payment.5. Changes to the commission idea, character, pose, outfit, expression, or other important details can be requested before I start working on the commission.6. Once I start working on the commission, new details or changes that were not clearly mentioned beforehand may be rejected.7. Complex character designs, markings, accessories, outfits, or backgrounds may incur an extra charge.8. All prices are listed on my Carrd, and by commissioning me, the client agrees to these prices.9. Discounted commissions, experimental commissions, emergency offers, old prices, or “test” icons do not guarantee the same price for future commissions.
2.2 Payment and taxes (VAT)
1. 100% of the final price must be paid upfront before any work begins.2. Payment methods: PayPal (preferred) and Ko-fi.3. Prices are in Euros (€). The client covers conversion fees to ensure I receive the exact amount in EUR.4. EU TAX (VAT): If the client is located within the European Union, a 21% VAT will be added to the final price as required by law. The client must inform me if they are from the EU as soon as I accept the commission so I can calculate the final total correctly.
3. Workflow, Queue, Trello and Revisions
1. I work through commissions in an organised queue. The client is responsible for checking my Trello Queue to follow the progress of their commission.2. I may work on up to 5 commissions per working day, depending on complexity, workload, and availability.3. Estimated dates for WIPs or final delivery are not strict deadlines unless explicitly agreed beforehand.4. I reserve the right to adjust WIP or delivery dates if necessary due to workload, health, stress, personal reasons, emergencies, or unforeseen circumstances.5. A WIP (Work In Progress) of the sketch will be sent for review when applicable.6. Important: My work schedule will not be delayed by a client's slow response. Once the sketch WIP is sent, I may continue working even if a response has not been received, in order to keep the queue moving.7. Changes will only be accepted if they are corrections to details that were already provided before I started working on the commission.8. New details, ideas, outfits, accessories, expressions, poses, markings, background changes, or character changes that were not mentioned before I started working on the commission may be rejected.9. At the moment, major changes after the sketch/WIP has been sent will not be accepted, even for an extra fee. This is due to high demand and my current workflow while I organise my commission schedule better.10. It is the client's responsibility to provide clear and complete information before I start working. Missing or unclear information may limit the changes I can make later.11. If the client wants their commission to be completed earlier than the estimated date, they may request a Rush Fee.12. The standard Rush Fee is +50% of the final commission price before VAT. If VAT applies, it will be added after calculating the rush fee.13. I do not work on Saturdays, Sundays, or public holidays. If the client requests delivery on a Saturday, Sunday, public holiday, or asks me to work during those days, the Weekend Rush Fee is +100% of the final commission price before VAT.14. Rush Fees are subject to availability and may be refused if my schedule does not allow it.
4. Copyright and Usage Rights
4.1 Client's RightsThe artist retains the intellectual copyright of the artwork. The client receives a personal use license for the commissioned piece.The artwork may be used for personal enjoyment, icons, banners, profile pictures, character profiles, and other non commercial personal uses.4.2 Commercial Use
For any commercial use (selling, merch, etc.), the client must contact the artist first. A commercial fee may apply. Using art commercially without permission results in a permanent blacklist.4.3 Publication, Portfolio and SpeedpaintsI reserve the right to post commissions for portfolio and promotional purposes, unless agreed otherwise before payment, including but not limited to Twitter/X, Instagram, TikTok, YouTube, Carrd, commission sheets, and other social media platforms.Some commissions may be recorded and used as part of speedpaint videos, timelapses, behind the scenes content, WIPs, process videos, or art related content on my YouTube channel (@CopitoArts) or other social media.If the client does not want their commission to be posted publicly, recorded, or used in a speedpaint/process video, they must tell me before payment.Once the commission has been accepted and started, privacy or recording restrictions that were not mentioned beforehand may not be guaranteed.
5. Cancellations and Refund Policy
Before the sketch is started: 100% Refund.During the sketching phase: 50% Refund.After the sketching phase: 0% Refund. No exceptions.
6. Prohibited Content and Conduct
6.1 "I Will Not Draw"
No NSFW, no hate speech/discrimination (Homophobia, Queerphobia, etc.), no Nazi/Fascist imagery, no pedophilia, and no adult/minor pairings.6.2 Client Conduct
This is a professional vendor-client relationship. Critiques must be respectful. I will not tolerate mocking, condescending, or derogatory comments.
